Types of H-Visas

There are several types of H visas. Each has its own specific requirements and purposes. The most common types of H visas are:

  • H-1B visas are issued to foreigners with a bachelor's degree or equivalent work experience in specialty occupations like IT, engineering, and science.
  • H-2A visas are for foreign agricultural workers who come to the United States to perform temporary or seasonal agricultural work.
  • H-2B visas are issued to foreign workers who come to the U.S. to do temporary or seasonal non-agricultural work, like tourism or construction.
  • H-3 visas are issued to foreign trainees who come to the United States to receive training not available in their home country.
  • H-4 visas are for spouses and dependents of H-1B visa holders. It allows them to live in the United States but not work unless they obtain their own work visa.

Each H-visa has its own specific requirements and limitations. An H-1B visa has an annual cap, whereas H-2A and H-2B visas require a labor certification from the U.S. Department of Labor.

What is an H1B Visa?

The H1B visa is a very popular work visa. It was created by the US Immigration and Nationality Act of 1952. These visas allow non-immigrant temporary workers to work in the United States. This category is currently capped, with only 65,000 H1B visas issued each fiscal year. 

H-1B visas are intended for foreign workers with specialized skills or knowledge in a field, like science, engineering, or IT. In order to obtain an H-1B visa, a worker must possess a bachelor's degree or higher, or equivalent work experience in the same field as the job they will perform here.

Employers can sponsor H-1B visas by submitting petitions to U.S. Citizenship and Immigration Services (USCIS) on behalf of the employee. A foreign worker must be paid a prevailing wage and there must be a shortage of qualified U.S. workers for the position. There is a limit on H-1B visas available. As of now, there are 85,000 visas per year, with 20,000 reserved for workers with master's degrees or higher.

H-1B Visa Eligibility

To qualify for the H1B visa, you must meet some requirements:

  • Your intention for entering the United States is to perform work in a specialty occupation.
  • Specialty occupations are those which require a Bachelor's degree or higher. In other words, you may qualify for one of these visas if the job for which you are applying is so complex that only individuals with a degree are able to do the work.

An H1B visa is normally granted for three years and may be renewed for another three years.
